Equalization is complicated.  It is legislated to ensure that both spouses share in the wealth accumulated during the length of the marriage (or, in rare cases, during the period of common-law cohabitation).  It is essential to have experienced counsel at this stage, advocating for you through the nuances of property division.

 

It is a misconception among many members of the public that non-married spouses are entitled to an equalization, identical to that between married spouses.  This is not the rule but the exception.  Unmarried spouses have to pass additional hurdles before being entitled to an equalization.   This is a nuanced area of law that requires an experienced lawyer to navigate.
